Civil personality is something that comes with every person upon his or her birth and while this may be limited by a number of other things, in general, every person would have a civil personality. The importance of civil personality is the fact that no person could enter into a valid contract unless he has the civil personality to do so. Any contract entered into with a person who has no civil personality has no effect at all. It is important to be aware of the events that limit the civil personality of a person, and one of these events would be death, though, strictly speaking, death terminates civil personality. This is one of the reasons why death records like Utah Death Records are being requested for.

Utah Death Notices are the best evidence that one could present in order to prove the happening of the event. Often, these death notices are also required to commence a special action that the law would allow for the party who had survived to resort to in order to make good his or her rights under the contract. Take the case of a person whom the deceased still owe money to, and because the deceased is already dead, then the creditor could no longer go after him, instead, the creditor could go after the estate of the deceased and to do so, he would have to bring action against the estate of the deceased which would only happen in probate proceedings where a death notice or certificate is required.

Copies of tah Death Certificates are available at the state level, but not every person may make a request for the records in question because death records are not public records, though they do enjoy the presumption of regularity of business that is usually reserved for public records. Only a person who has a substantial interest in the death of the person could make a request for the records, and even then, they would be required to provide proof of their interest in the death of the deceased.

To request for copies of Cause of Death records, the person who is eligible to make the request would first have to download the required request form and accomplish the same. Note that the person should make sure that he is eligible to make the request. Once the form is accomplished, the next step would be to determine the required fee and to make a money order or personal check to answer for the same. The required fee is eighteen dollars for the first record to be request, plus an additional eight dollars for every request that would be requested for at the same time. Once accomplished, the completed application form and all other attachments should be sent to the office for processing.

Of course, it is also possible to request for copies of death records online through the use of online databases. These online databases are faster and more efficient to use, but because they are mostly privately owned, the records located using these methods could not be used for official proceedings.

The following procedure must be followed when making a request for death records

  • Determine first if you are eligible to make the request.
  • If you are eligible, then download the required request form
  • Accomplish the request form.
  • Determine your required fee and make a money order or personal check to answer for the same.
  • Send the accomplished form and all other attachments, including a copy of any valid government issued identification card to the office for processing.
