It is said that there are only two things in life that is certain, death and taxes. The former, of course, is something that has far more reaching consequences, at least when it comes to the people that the decedent would leave behind. This is because death is something that does terminate all the relationships of the decedent. These relationships are often professional or personal, and it is mostly the former, interpreted in a contract, that is terminated when a person dies. Like all death notices, New York Death Notices are not public records in the sense that they are not available to the public at any given time and no matter what the reason for the request would be. Death notices are only available to certain people enumerated by an exclusive list provided for by law, and if the person making the request is not amongst those, then he or she could not actually request for the records. In the sense of presumption of regularity, however, death notices enjoy presumption of regularity such that the contents of the record are considered to be true at all times.

Except for New York City, copies of New York Death Certificates may be obtained from either the local or national sources. The local or county level source would be the registrar of vital statistics of the county where the event occurred. It is important to note that the registrar of vital statistics is limited in the territorial sense, such that the person who desires the records should write the registrar where the event occurred because of the event occurred outside the territorial jurisdiction of the registrar, then the chances are that he would not have copies of the records.

A request for death records does request the payment of a minimal fee and as such, there is no such thing as a Free Death Record, but the fee to be paid is minimal. At the state level, the required fee is thirty dollars. The procedure to request for death records at this level would require the person who desires the record to obtain the request form and accomplish the same before sending it to the New York State Department of Health for processing. Note that when the form is sent, it must be accompanied by a money order or check to answer for the required fee. The usual processing time is anywhere between six to eight weeks, though there is the option for an expedited services in exchange for a higher fee.

Of course, cheaper death records may be obtained online through the use of online databases, and these records are substantially the same as those records that are provided for by the government databases and offices. In addition, it is also easier to use online databases because the only requirements to use these databases are a computer with an internet connection and the most basic knowledge of internet search.

A request for copies of death certificates at the state level should follow the procedure given below

  • Obtain the request form
  • Accomplish the request form and determine your required fee.
  • Once the required fee had been determined, make a money order or check to answer for the required fee.
  • Make a photocopy of a government issued valid identification card and attach the copy to the accomplished form.
  • Send all the requirements to the New York State of Department Health for processing.
  • Wait for the department to process your request.
