Canada Birth Records
Most people believe being born and existing are one and the same, but in the context of the effects of the two, these two are actually very different from each other. The fact that a person exist merely means that the person is tangible and could interact with the members of the community, but this does not give the person rights and responsibilities as one has to be born before the proper civil status could attach upon the person in question, and it is the civil status of the person that determines the rights of that person relative to other people. There is thus the need to prove the fact of the birth of the person, and the best way to do that would be through the use of birth records like Canada Birth Records.
One of the places where there is a need to prove the fact of the birth of the person, and therefore the need to present copies of Canada Birth Certificates, would be during the probate proceeding of the estate of the deceased. Any person can claim to be the heir of the deceased and thus, would be entitled to the properties left behind, but only those who could actually prove that fact would be considered to be an heir of the deceased, and the best way to prove the fact of the relationship would be through the use of these records.
These records are the official records of the government in regards to the fact of the birth of the person named in the record and that is the reason why Canada Vital Records are given the presumption of regularity such that the contents of the records are presumed to be true and accurate at all times. This means that there is no obligation on the part of the party presenting the records from having to prove that the contents of the records are true and accurate, but there is still the need to prove that the records were obtained from the proper sources as only such records would be given the presumption of regularity. It must be noted, however, that proving that the records were obtained from the proper sources is easier than having to prove that the contents of the records are true and accurate.
A request for copies of the records in question is usually done at the national or state level, and the procedure for making the request at this level would usually be to make the request through the mail. This method of request would require that the person making the request should first send a request to the office where the records are being kept, and because the office could not act on the request until it is received, a request at this level would usually take longer than anywhere else.
Of course, it is also possible to make the request for copies of the records online through the use of internet based online databases, but it must be noted that these online databases are mostly privately owned and not government sources. This means that they are not official sources and could not enjoy the presumption of regularity even if they could provide information that would substantially and practically be the same as that which could be found from the official sources.
